1. Scope & Acceptance

These Terms & Conditions (“Terms”) govern all purchases, whether made:

through our website www.earthlyjewels.co,
via WhatsApp, phone, or social media orders, or
at our physical retail store located at the address above.

By purchasing from Earthly Jewels Pvt Ltd, you (“Customer”) agree to be bound by these Terms. Earthly Jewels Pvt Ltd (“we,” “our,” or “us”) reserves the right to amend these Terms at any time without prior notice.

2. Eligibility

You must be at least 18 years of age to purchase from us. By placing an order, you confirm that you are legally competent to enter into binding contracts under Indian law.

3. Orders & Acceptance

Online Orders: An order is confirmed only after full or partial payment and written confirmation from our team.
In-store Purchases: An order is confirmed upon issuance of an invoice/receipt at our store.
We reserve the right to accept, reject, or cancel any order at our discretion, including due to incorrect pricing, stock unavailability, or incomplete information.

4. Pricing & Payment

All prices are listed primarily in INR and inclusive of applicable taxes, unless stated otherwise.
Payments may be made via UPI, net banking, debit/credit card, cash, or approved financing/EMI partners (where applicable).
Prices are subject to change without prior notice. In case of a pricing error, we may cancel/refund the order.

5. Delivery, Shipping & Risk

In-store Pickup: Risk of loss passes to the Customer upon collection from our store.
Courier/Shipping: All our couriers are covered under insured shipping. Risk transfers to the Customer once the product is handed over to the customer by our shipping partners.
Estimated delivery times are provided for convenience and are not guaranteed. Delays caused by courier, customs, or external events are beyond our control.

6. Returns, Exchanges & Cancellations

Custom-made, engraved, personalized, or resized items are non-returnable and non-refundable.
Standard products may be eligible for exchange or return only incase of manufacturing defects in the product, provided they are in unused condition with original invoice, packaging, and certificates.
Shipping/handling costs are non-refundable unless due to our error.
Cancellation of online orders must be requested within 48 hours of placing the order. Custom orders cannot be cancelled once work has begun.

7. Product Authenticity & Warranty

Our diamonds are lab-grown and accompanied by authentic certification from recognized grading laboratories.
Earthly Jewels Pvt Ltd warrants products against manufacturing defects. Upon purchase if you notice any manufacturing defects, we will fix it for you. This warranty does not cover normal wear and tear, mishandling, unauthorized repairs, or accidental damage.

8. Intellectual Property

All designs, trademarks, images, logos, and content are the intellectual property of Earthly Jewels Pvt Ltd. No part of our website, catalog, or store displays may be reproduced or used without prior written consent.

9. Privacy & Communication

Personal information collected during online or offline purchases is handled in accordance with our Privacy Policy.
By purchasing from us, you consent to receive order-related communications via SMS, WhatsApp, phone, or email.

10. Virtual Try-On & Image Processing

Our website may provide a Virtual Try-On feature that allows you to preview selected jewellery or products using images uploaded by you, including photographs of your face, hands, body, or other relevant images required for the Virtual Try-On experience.
When you use the Virtual Try-On feature, you understand that the images and related information you submit may be collected and processed to provide the Virtual Try-On service, generate the requested visualization, operate and maintain the feature, troubleshoot technical issues, and improve the functionality and quality of the Virtual Try-On experience.
To provide the Virtual Try-On service, your uploaded images may be processed by our systems and by third-party technology, artificial intelligence, cloud, image-processing, or other service providers engaged by us for this purpose. Such providers may process the images on our behalf in accordance with applicable contractual, security, and data-protection requirements.
Your uploaded images will be handled in accordance with our Privacy Policy. We will retain or store such images only for as long as reasonably necessary for the purposes for which they were collected, or as otherwise required or permitted by applicable law. Where applicable, images may be deleted, anonymized, or otherwise securely disposed of when they are no longer required for those purposes.
We take reasonable technical and organizational measures designed to protect images and other personal information processed through the Virtual Try-On feature against unauthorized access, use, alteration, disclosure, or loss. However, no method of transmission or electronic storage can be guaranteed to be completely secure.
Your use of the Virtual Try-On feature is voluntary. If you do not wish to have your images processed for this purpose, you should not upload images or use the Virtual Try-On feature.
For information about the categories of personal information we collect, the purposes for which it is processed, applicable data rights, consent withdrawal mechanisms, retention practices, and how to contact us regarding your personal information, please refer to our Privacy Policy.
If the Virtual Try-On feature involves any processing of your images for purposes beyond providing, operating, maintaining, or improving the Virtual Try-On service, we will provide the applicable information and obtain any consent required by law before carrying out such processing.

11. Limitation of Liability

To the fullest extent permitted by law, Earthly Jewels Pvt Ltd shall not be liable for any indirect, incidental, or consequential damages arising from the purchase or use of our products.
Our liability shall not exceed the actual purchase price paid for the product in question.

12. Force Majeure

We shall not be held responsible for any delay, cancellation, or failure in performance caused by events beyond our reasonable control, including natural disasters, strikes, transport delays, courier disruptions, or government restrictions.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.

14. Store Conduct

Visitors to our retail store are expected to respect store property, staff, and security measures. Any misuse, theft, or damage may result in legal action.
